The use of information collected through our Service shall be limited to the purpose of providing the service for which our Clients have engaged Native Touch.
Our Business
Native Touch is a mobile advertising company. We use our proprietary technology to offer mobile advertising solutions to our clients, which includes working with advertisers to deliver their advertising campaigns across mobile publishers and applications developers. Native Touch collects information under the direction of its Clients, individuals whose data it processes.
Platform Data Collection
Native Touch collects data from across its Platform as outlined below. This data, which may include anonymous identifiers associated with your mobile device, does not identify you personally, as well as unique device ID, and may come from such sources like the apps that you use. We use this data along with our technology to perform a variety of tasks, such as limiting the number of times a specific advertisement is presented to the same mobile device (frequency capping), providing an advertisement to only certain types of mobile devices, or providing a report to a client on the number of its advertisements that were clicked. We may also use interest-based advertising, as discussed more fully below.

Location Data Collection
Native Touch collects and uses precise location data to help advertisers provide more relevant offers to mobile application users. Native Touch receives this location information either from an "SDK" that it provides to mobile applications ("apps"), or from a server-to-server transfer and integration with mobile app partners. This location information generally includes lat./long. data, i.e., GPS-level data, and/or WiFi data (if feasible) associated with a unique mobile device ID
We use the information we collect to make inferences about what types of activities users tend to spend time doing. We use this information to categorize Device users into "interest segments" - which advertisers can use to send ads when those users appear on mobile ad platforms they work with.
We also use some of the information we collect (including location information or mobile advertising IDs) to help advertisers analyze aggregate ad performance - such as by measuring whether or how Devices that saw a particular ad tended to engage with a particular product. In addition, we sometimes use any or all of the above information to help advertisers better understand their customers or their marketing, such as for market research, customer analytics, or analytics of traffic patterns.
When you have accessed or used and opted-in to an App that collects this data, the Publishers of such App may allow us to automatically collect what we define as "Non-Personal" information about your Device and your activity and interaction with such App ("Non-Personal Information"), which may include:
- IP address
- Geolocation and proximity of your Device if location services are enabled on your Device
- Unique Device identifiers for advertising (Google Advertiser ID or IDFA) and/or a pixel identifier
- Time and date information
- Other non-personal information that Publishers share with us
- Dwell time near points of interest, as determined through beacon, Wi-Fi, and other signals as discussed below and our proprietary systems
That information is sent to our server through an Application Protocol Interface ("API") in encrypted form, via a HTTPS protocol.
We also collect Non-Personal Information from third-party devices present at certain third-party locations, such as stores, shopping malls, stadiums, bars, restaurants, and other points of interest. Such devices may use Wi-Fi, near field communication (NFC), or Bluetooth low-energy (BLE) beacon technology to transmit signals about the location of your Device to us.

Interest-Based Advertising
Native Touch works with its clients to provide ads that are likely to be more interesting and more relevant to mobile device users based upon the interests inferred from the purpose of the app downloaded by users. One way we do this is by using our technology, along with Non-PII related to your mobile device that is gathered across different sources such are our clients when they make requests from our Service. Examples of this data, which does not identify you personally (Non-PII), may include things like apps that you use or preferences that you may have provided to your app provider or to Native Touch (as in a survey).
Data Collection on behalf of third-parties
We may, on behalf of our clients, collect information from end users. This may occur, for example, if someone submits information in response to an ad that we provide on behalf of an advertising client. In such situations, we collect the information and provide it to our client, and it will be subject to such client’s privacy practices. Native Touch collects information under the direction of its Clients, and has no direct relationship with the individuals whose personal data it processes.
Security
Native Touch takes steps to use generally accepted standards to protect the security of information that we collect. To that end, we have designed and deployed hardware, software, and networking solutions to reasonably secure and protect access to our systems and data. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
Legal Disclaimer
We may need to disclose information, including PII, when in our good-faith judgment we are required to do so by law, or when such action is necessary to comply with a current judicial proceeding, a court order or legal process. We may also transfer all or some of the data discussed in this policy, in connection with assets, bankruptcy, or other corporate change.
Data Retention
We will retain your information for as long as your account is active or as needed to provide you services and for the purposes of maintaining your choice options with us. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Hosting
The Services are hosted in Canada. If you access our website or the Services from any jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from the laws of Canada, please be advised that through your continued use of the Services, you are transferring your Personal Information to Canada and you consent to that transfer. Additionally, you understand that your Personal Information may be processed in countries (including the United States) where laws regarding processing Personal Information may be less stringent than in your country.
Governing Law and Dispute Resolution
This Privacy Policy, and all related matters are governed solely by the laws of Ontario, Canada and applicable federal laws of Canada, excluding any rules of private international law or the conflict of laws which would lead to the application of any laws. To the extent legally permitted, any claim or cause of action you may have arising from, connected with, or relating to this Privacy Policy or our handling of your Personal information, or any related matters must be commenced within six (6) months, after the claim or cause of action arises, after which time the claim or cause of action is forever barred, regardless of any statute or law to the contrary.
